1. Acceptance of Terms

By creating a LawnDesk account or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use LawnDesk.

2. Use of the Service

LawnDesk is a business management platform for landscaping professionals. You agree to use the service only for lawful purposes and in accordance with these terms. You are responsible for all activity that occurs under your account.

3. Subscriptions & Billing

LawnDesk offers paid subscription plans billed monthly. All subscriptions include a 14-day free trial. After the trial, your chosen plan will be billed automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.

4. Refunds

We do not offer refunds for partial subscription periods. If you believe you were charged in error, please contact us at support@lawndesk.com within 30 days of the charge.

5. Data Ownership

You retain full ownership of all data you enter into LawnDesk, including client records, jobs, and invoices. We do not claim any rights over your business data. Upon account deletion, your data will be permanently removed within 30 days.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to LawnDesk. We are not liable for any losses resulting from service outages or interruptions.

7. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or otherwise misuse the service.

7a. Platform Administration & Account Access

As the operator of LawnDesk, we may access your account for the purposes of customer support, technical troubleshooting, security investigations, billing disputes, and platform maintenance. This access is limited to what is necessary to resolve the issue at hand. We do not share your account data with third parties except as required by law or as described in our Privacy Policy.

8. SMS Messaging

Program name: LawnDesk SMS Notifications. By providing your phone number and opting into SMS notifications, you agree to receive automated service-related text messages from LawnDesk, including appointment reminders, job status updates, invoice links, and estimate notifications.

Message frequency varies based on your service schedule. Msg & data rates may apply based on your carrier plan.

To opt out of SMS messages at any time:

  • Reply STOP to any SMS message from LawnDesk
  • Disable SMS notifications in your account settings
  • Contact us at support@lawndesk.com

9. AI Receptionist & Platform SMS

LawnDesk enables business subscribers ("Operators") to send automated SMS messages to their end clients through the LawnDesk platform, including appointment reminders, follow-up notifications, and service confirmations triggered by AI-assisted call handling. Operators are solely responsible for obtaining proper prior express consent from their end clients before sending any SMS messages through LawnDesk. LawnDesk acts as a platform provider and technology intermediary — it is not the sender of record for Operator-initiated messages. By using LawnDesk's messaging and AI receptionist features, Operators agree to comply with all applicable laws and regulations governing automated communications, including the Telephone Consumer Protection Act (TCPA).

10. Payment Processing

Online invoice payments made through LawnDesk are processed by Stripe, Inc., a third-party payment processor. By paying an invoice online, you agree to Stripe's Terms of Service.

Standard payment processing fees charged by Stripe apply to all transactions (currently 2.9% + $0.30 for card payments; 0.8%, capped at $5.00, for ACH bank transfers). These fees are deducted from the payment and are not charged by LawnDesk. LawnDesk does not charge additional transaction or platform fees beyond your subscription.

Landscaping businesses using LawnDesk to accept client payments may connect a Stripe Express account to receive funds directly to their bank account. LawnDesk is not responsible for delays in fund settlement, which are governed by Stripe's payout schedule.
